Chinese electric vehicle (EV) maker Nio has secured a significant legal victory in Australia, where the Federal Court ruled in its favor in a trademark dispute with Audi.
The case centered on Nio’s use of the “ES” designation for its EV lineup, which Audi argued could confuse consumers due to its similarity to Audi’s “S” and “RS” series.
Audi claimed that the naming convention might mislead Australian buyers, especially as EV adoption continues to grow. Notably, Audi previously won a similar case in Germany, forcing Nio to rename its “ES” models to “ET” in that region.
However, in Australia, the court dismissed Audi’s concerns, stating that there was no substantial risk of consumer confusion between Nio’s ES models and Audi’s performance series.
This legal triumph is a major milestone for Nio as it eyes global expansion. The ruling clears the path for Nio to proceed with its plans to introduce the ES6 and ES8 models in Australia without legal barriers.
The victory also strengthens Nio’s position in the competitive EV market, signaling that it is ready to challenge established players like Audi on the global stage. With this dispute resolved, Nio is set to accelerate its growth and establish a strong foothold in the Australian market.
