Shannon Ruth, a woman who filed a lawsuit against Nick Carter in December 2022 for alleged sexual violence, is attempting to have his most recent counterclaim thrown as the couple’s court case proceeds.

The Tuesday-filed motion claims that the 43-year-old Backstreet Boys singer filed his lawsuit “with the objective to harass and intimidate Plaintiff, restrict her right to free speech, and use his vast wealth and celebrity profile to outlive Ruth.”

That kind of allegation is referred to as a “strategic lawsuit against public participation,” or “SLAPP,” in accordance with her attorneys. According to the petition, Nevada has particular statutes in place to stop this kind of action or “at minimum, limit its malevolent objective” by requiring the filing party to demonstrate that there is a chance of success before proceeding.

Mark J. Boskovich, the lawyer for Ruth, and Michael Holtz, the lawyer for Carter, did not immediately respond to requests for comment.

Ruth’s attorneys contend in the motion that Carter’s counterclaim is merely an attempt to utilize his notoriety to “outlast,” “intimidate,” and “outspend” Ruth in order to avoid having to defend herself in court.

According to the motion, the singer “hiding behind the absurd assertion that Plaintiff is just looking for attention and publicity by claiming to be a “victim” of the #MeToo Movement. This litigation fits the criteria of a SLAPP in every way, and it shouldn’t be permitted to continue.”

Ruth declared in a press conference that she was suing Carter in December 2022. Ruth, who is autistic and has cerebral palsy, said that Carter approached her while she was in line for autographs following a Backstreet Boys concert in Tacoma, Washington, in 2001.

According to the documents, the singer allegedly asked Ruth if she wanted a drink and when she said she wanted apple juice, he allegedly handed her a red beverage he termed “VIP juice.”

Ruth asserts that Carter told her the drink was cranberry juice, but she thinks it also had alcohol. Both accusations have already been refuted by the singer. He contends that he doesn’t think he’s ever met Ruth.

In February, Carter counterclaimed against Ruth. He is also suing Melissa Schuman, a former member of the girl group Dream who accused him of rape in 2017, in his counterclaim.

According to the news, the counterclaim claims that the two women conspired over a five-year period to “defame and vilify Carter and otherwise damage his character for the purposes of earning notoriety and fame and/or extorting money from Carter” by using the #MeToo movement as a springboard.

Ruth, now 38, and Schuman are also referred to as “opportunists” who set out to “damage innocent lives” and who, following the December accusation, caused more than $2.3 million in company losses.

According to the counterclaim, Ruth was “a weak and very impressionable individual, needing attention and desperate to fit in” when Schuman and her father Jerome Schuman allegedly groomed her.
