The Alabama court ruling declaring frozen embryos created through fertility treatment as children has presented Democrats with an election-year opportunity and Republicans with a political headache. Joe Biden’s party is actively campaigning on the controversy, framing November’s vote as a battle for reproductive rights. The row could potentially hinder Republicans’ efforts to regain support from suburban women and swing voters. Since last week’s ruling, at least three fertility clinics in Alabama have suspended in-vitro fertilization (IVF).

The all-Republican justices determined that frozen embryos created through IVF are considered children under state law. Although the ruling does not prohibit or limit IVF, several medical providers in the state have halted fertility services in recent days due to concerns about potential legal consequences. On Thursday, President Biden attempted to attribute the ruling to his predecessor and likely Republican challenger in this year’s election, Donald Trump.

In a post on X, formerly Twitter, Mr. Biden asserted that the Alabama decision was only possible due to the 2022 ruling by the US Supreme Court – which includes three Trump appointees – nullifying abortion rights. While many conservatives celebrated the end of Roe v. Wade, it served as a powerful motivator for Democrats to get out and vote, while posing a messaging challenge for Republicans. Mr. Biden’s party hopes that the fallout over IVF in the Deep South will similarly energize their electoral base, akin to the abortion issue. Democrats are already portraying the Alabama case as a harbinger of further attacks on women’s rights if their opponents gain ground in the upcoming general election.

During a stop on her “Fight for Reproductive Freedoms” tour in Grand Rapids, Michigan, on Thursday, US Vice-President Kamala Harris leveled accusations of hypocrisy against Republicans.
