KARACHI: The Sindh High Court (SHC) on Tuesday dismissed the petition of Mirza Ishtiaq Baig, who claimed himself to be the widower of 1980s pop music sensation Nazia Hassan, for the cancellation of a divorce certificate purportedly issued in March 2008 by secretary Union Council No 1 Bhutta Village.

The petitioner claimed that the divorce certificate issued eight years after the death of his wife was mala fide and was a practice of widespread forgery and bribes besides an attempt to extort money from him.

The petitioner claimed that he was the lawfully wedded husband of Nazia Hassan who died in London in 2000.

A two judge-bench headed by Chief Justice Ahmed Ali M Sheikh after hearing the counsel for the petitioner announced its order.

The bench in its order maintained that the petitioner alleged that mala fide and bribery was involved in the issuance of the divorce certificate, however, he did not present any material to back his allegations.

The bench observed that in such circumstances extraordinary constitutional jurisdiction of the high court could not be invoked. The bench while dismissing the petition observed that the petitioner could avail of any alternative remedy available to him.

Earlier in September, Mirza Ishtiaq Baig had sued his brother-in-law Zohaib Hassan for allegedly holding Baig responsible for his sister’s death and hiding facts of an inquiry. Another bench of SHC had restrained Zohaib from making defamatory remarks against Baig.
