The Biden administration’s significantly narrowed priorities for Immigration and Customs Enforcement (ICE) were overturned by a court on Saturday. The Department of Homeland Security said it will follow the decision. Agents will make decisions on a case-by-case basis. According to DHS, “ICE agents and officers will make enforcement decisions on a case-by-case basis during the appeals process in a professional and responsible manner.

According to the September letter, which codified temporary rules released in February 2021.

Alejandro Mayorkas, the secretary of DHS, stated in the memo that “the fact that an individual is a removable noncitizen consequently should not alone be the foundation of an enforcement action against them.”

“We’ll exercise judgment and direct our enforcement efforts more precisely. It’s necessary for justice and the health of our nation.”

Arrests and deportations have drastically decreased under the policy.

Only 47,755 of the 74,082 arrests however made between October 2020 and October 2021. Texas and Louisiana filed a lawsuit against the memo.

The court decision was the Biden administration’s most recent setback with regard to immigration concerns. Tipton had already opposed earlier ICE rules last year as well as a planned 100-day halt on deportations.
