New York became the second state this week to pass legislation requiring weapons manufacturers to employ microstamping. A technique that allows guns to imprint microscopic codes on ammunition cartridges as they are shot, generating a unique signature that authorities may use to assist solves crimes.

However, it is unclear if the new regulation would result in such firearms being offered for sale. A similar law was enacted in California 15 years ago. No firearm capable of microstamping has been introduced for sale in that state since then.

Instead, gunmakers have removed new handgun models from the California market rather than equip them with the technology, which opponents say is expensive and ineffective. Both states are now attempting different methods of putting pressure on manufacturers. Supporters of New York’s new law believe it has the potential to succeed where California failed.

“The New York legislature has established a more rigorous structure that will generate a set of requirements and evaluations that do not rely on the gun industry to give them a thumbs up or thumbs down.

“The challenge here is giving a forensic technique to identify a handgun when a firearm is not found.

When the gun discharges, the shell casing is branded with that unique number or code. Investigators from law enforcement agencies might then collect casings from crime scenes.

State officials will investigate if microstamping is as technologically feasible as its backers say. If the response is “yes,” the state has set a deadline of four years to establish rules.
