IHC orders to produce Hassaan Niazi in court

Islamabad High Court (IHC) on Monday ordered police to produce Pakistan Tehreek-e-Insaf (PTI) leader and focal person on legal affairs Hassaan Khan Niazi in court tomorrow.

Advocate Faisal Chaudhry has filed a petition in for the release of the PTI leader after he was taken into custody.  The petition stated that police “abducted” Hasaan Niazi from the premises of Judical Complex after he obtained bail in a case.

The representatives of SHO Ramna police station and Inspector-General Islamabd appeared before the court. IHC Chief Justice Aamer Farooq inquired from the police officer about the whereabouts of Niazi.

“Have you picked Hasan Niazi,” the judge asked SHO Ramna police station. The policeman confirmed arresting Niazi and submitted a copy of the FIR.

The judge said the case has been registered today. He said lawyer Faisal Chaudhry will be present during the investigation.

The chief justice asked the representative of IG Police Islamabad if Niazi has been presented before a magistrate. He said rules cannot be violated and the accused should be given due rights.

He asked if the medical test was conducted and why the accused has not been presented before the magistrate. He said there should no violence while Niazi is under custody.  The chief justice instructed that the investigation should be in accordance with the law,

Lawyer Faisal Chaudhary said there were hidden FIRs that were not even presented in court. The Chief Justice said the accused belongs to a political party but his basic rights should be respected.

The court allowed Niazi to meet his legal team and family. The court also ordered to provide medical assistance and present him before a court within 24 hours.

Police registered the case at Ramna police station against Hassaan Niazi for invention in official affairs, display of weapons, and misbehaving with police officials.

The First Information Report (FIR) said Assistant Superintendent (ASI) Khoban Shah tried to stop the car but the driver rammed the car over the policemen. The complaint said Hassaan Niazi also threatened to kill him.

The FIR said Niazi was accompanied by another person who took out a weapon and managed to get out of the vehicle and escaped. It said Niazi was arrested by police and taken into custody.

Hassaan Niazi was arrested from outside an anti-terrorism court in Islamabad where he appeared during the hearing of a case against PTI leaders.
