Chief justice blocks Donald Trump’s immigration policy
Chief Justice John Roberts temporarily halted a lower court ruling that would eliminate a Donald Trump-era immigration strategy enacted during the outbreak to promptly turn away asylum-seekers at the border.
Republican-led states petitioned the court to maintain the policy.
Roberts halted the federal district court verdict, which was set to take effect Wednesday. The Biden administration and others challenging the program must respond by Tuesday afternoon.
Nineteen states led by Arizona and Louisiana submitted an emergency motion after the U.S. Court of Appeals for the DC Circuit rejected their plea to intervene in the case to prevent Title 42 from being wound down.
“Removing Title 42 will dangerously and needlessly imperil more Americans and migrants,” Arizona’s attorney general stated.
The states argue President Joe Biden’s administration “abandoned serious defense” of the rule and helped challengers design a verdict to abolish it. The states want to intervene to preserve it. The appeals court said the states waited too long to intervene.
A federal judge blocked the administration’s prior attempt to reverse the policy.
Title 42 gives the government emergency ability to keep illnesses out of the country. Trump used it during the coronavirus pandemic, and it remains in existence under Biden. More than 2 million individuals were expelled.
Various civil rights groups, including the ACLU, opposed the policy.
DHS said it would maintain Title 42 in effect under the Supreme Court’s ruling and continue preparing “to administer the border safely, orderly, and humanely” if it were lifted.
“We urge Congress to take this time to give the funding we’ve sought for border security and management.”
