When the “Rust” movie begins filming, it will not be in New Mexico, where actor Alec Baldwin tragically shot cinematographer Halyna Hutchins in 2021, according to a lawyer for the production firm.

The statement follows the settlement of a legal dispute between Baldwin, Rust’s producers, and Hutchins’ family on October 5, according to which filming will resume in January with the same lead actors and director. Halyna’s husband, Matthew Hutchins, will serve as executive producer.

A local prosecutor stated following the deal that Baldwin and others could still face criminal charges in connection with the death of the 42-year-old cinematographer in October 2021 at a ranch near Santa Fe, New Mexico.

“The production of Rust will not return to New Mexico,” attorney Melina Spadone said in a statement on behalf of Rust Movie Productions. “The production is considering other locations, including in California, but no decisions have been made.”

When filming resumes, there will be a safety officer on set and labor union agreements will be in place, as was the case with the initial production, the firm stated in a statement.

Baldwin fatally shot Hutchins when a rehearsal revolver he was using discharged a live cartridge that also struck director Joel Souza, who survived. The “30 Rock” and “Saturday Night Live” actor rejected blame for Hutchins’ murder and stated that live rounds on the set should never have been permitted.

The New Mexico Film Office, which promotes and provides services for state-based movies, did not reply to a request for comment. According to official data, spending on film and television production in New Mexico reached a record high of $855 million in fiscal year 2022.
