 According to a lawyer for the production business, the western movie “Rust” won’t resume filming in New Mexico, the location where actor Alec Baldwin tragically shot the movie’s cinematographer Halyna Hutchins in 2021.

Following a civil litigation settlement on October 5 between Baldwin, Rust producers, and Hutchins’ family, it was announced that filming would resume in January with the same main cast and director. The executive producer will be Halyna’s husband, Matthew Hutchins.

Following the agreement, a local prosecutor stated that Baldwin and others could still face criminal charges in connection with the 42-year-old cinematographer’s death in October 2021 at a ranch close to Santa Fe, New Mexico.

Rust Movie Productions’ lawyer Melina Spadone issued a statement on their behalf, stating, “The production of Rust will not return to New Mexico.” Although no decisions have been made, the production is examining alternative locales, including California.

When filming resumes, the movie will have a safety officer on set and, as was the case with the original production, production will be under agreements with industry labor unions.

When a revolver Hutchins was using during a practice discharged a live cartridge that also struck director Joel Souza, who survived, Baldwin, shot Hutchins to death. The “30 Rock” and “Saturday Night Live” star said live rounds should never have been permitted on the scene but denied taking responsibility for Hutchins’ passing.

Requests for a response from the New Mexico Film Office, which promotes and supports productions in the state, went unanswered. According to information from the office, spending on film and television production in New Mexico reached a record $855 million in the fiscal year 2022.
