Interviews with officials reveal that the White House is unlikely to adopt the courageous measures to defend women’s right to an abortion that Democratic senators have recently demanded.
President Joe Biden criticised the “extreme ideology” of the conservative Supreme Court in a speech following the overturning of Roe v. Wade on Friday, but added that there were few things he could do by executive order to defend women’s reproductive rights at the time.
Since then, lawmakers have suggested Biden limit the Supreme Court’s jurisdiction or increase its membership, end the “filibuster” rule in legislation, allow abortion clinics to be built on federal lands, declare a national emergency, and establish Planned Parenthood outposts outside of U.S. national parks, among other things. These lawmakers include Senator Elizabeth Warren and Representative Alexandria Ocasio-Cortez.
After the court rejected the right to an abortion, more than 30 Senate Democrats signed a letter to Biden encouraging him to “fight back,” take “strong action,” and “lead a national reaction to this tragic judgement.”
The White House is asking voters and Congress to take action while pursuing a more constrained range of policy solutions. In addition to committing to safeguard women who cross state borders for abortions and supporting medical abortion, the White House has a number of executive actions planned for the upcoming days.
According to sources within and outside the White House, Biden and officials are worried that more dramatic actions would lack a solid legal foundation, cause political polarisation ahead of the midterm elections in November, and erode public confidence in institutions like the Supreme Court.
When asked about the approach, a White House official stated that Biden is “telling folks the truth and putting the attention where it needs to be, holding Republicans’ feet to the fire for the harm they’re creating.”
