UAE Labor Law Update: Heavy Fines Introduced for Hiring on Visit Visas
The United Arab Emirates, home to millions of expatriates, has introduced significant changes to its Labour Law, imposing substantial fines on companies that hire visit visa holders.
The new regulations in this Middle Eastern country aim to restrict employers from employing individuals on visit visas. With this law now in effect, firms that hire visit visa holders without a confirmed job offer could face penalties of up to 1 million AED. A UAE consultancy firm stated that the government’s initiative is intended to protect workers’ rights and ensure legal employment practices within the country.
These legal adjustments were made to address the exploitation of visit visa holders, who are sometimes promised work permits and residency after their tourist visas expire, often without being paid for their labor.
UAE Labour Law Amendment 2024
In recent incidents, a foreign national was dismissed and fined Dh5,500 for overstaying his visa before departing the country.
The UAE government has made it clear that working on a visit or tourist visa will result in penalties and strict enforcement. Employment is only permitted after obtaining an offer letter from the Ministry of Human Resources and Emiratisation (MOHRE).
Legal experts strongly caution employers against allowing visitors to work illegally, as it can lead to serious legal repercussions.
The UAE’s new penalties are designed to discourage violations and increase accountability. The amendments also provide greater protection for employees, reducing the likelihood of illegal or unfair treatment.
Additionally, changes concerning small employment claims and MOHRE’s role in dispute resolution aim to streamline the legal process, benefiting both employees and employers by making it more efficient and cost-effective.
