Supreme Court of Pakistan on Friday validated the decision of the Election Commission of Pakistan (ECC) for holding re-election in NA-75 Daska.

According to the details, the top court has ordered the ECP to hold the repolling in the Daska by-election on April 10.

The court ruled, after hearing the arguments of Pakistan Tehreek-e-Insaf (PTI) and Pakistan Muslim League Nawaz (PML-N) lawyers. PTI had challenged the Election Commission’s decision to hold re-election.

The petitioner Ali Asjad Malhi who hails from PTI, stated in the petition that the decision of the Election Commission for repolling in Daska is a violation of ‘Article 10A’.

Ali Asjad Malhi in his petition said that the Election Commission has not properly reviewed the available records, ‘there is no justification for re-election in the constituency.’ He said.

He maintained in the petition that holding re-election would mean ‘pushing the people of the constituency back to the same state of law and order as before.’ He said, adding that, ‘the opposition had already lost the by-elections.’

The Election Commission had written in a detailed decision of NA-75 Daska by-election that the polling was declared null and void under Article 218 and Section 9 of the Election Act. ‘The February 19 election was not fair, transparent and free.’ The Election Commission said that the election was not ‘peaceful’.
