Oklahoma Enacts Abortion Ban in the Style of Texas

Oklahoma is just the latest in a string of Republican-controlled legislatures that looked to rush through a slew of contentious measures in recent months in anticipation of a Supreme Court decision that might shift jurisdiction on the issue from the federal government to the states.

The measure is now on its way to the governor’s desk. It would take effect instantly with his signature. The statute deputizes private individuals to enforce its limits, a process pioneered by Texas and has proven difficult to contest in court. Abortions would be prohibited if a fetal heartbeat is found, which can happen as early as six weeks of pregnancy.

The move comes after the legislature enacted a trigger measure on Tuesday in case the Supreme Court overrules its existing precedent established in Roe v. Wade and Planned Parenthood v. Casey “in whole or in part.”
It also comes after Gov. Kevin Stitt signed legislation earlier this month making abortions at any stage of pregnancy illegal. The measure, which is set to go into effect this summer, 90 days after the parliamentary session concludes, will penalize health care practitioners who perform abortions with up to ten years in jail and a $100,000 fine. It only provides an exception when the mother’s life is in danger.

Another Texas-style abortion ban, which would employ the same method but outright prohibit the operation, is also slated to be debated in the Oklahoma House on Thursday.
