Supreme Court orders demolition of high rise residential building in Karachi

Supreme Court of Pakistan on Thursday expressed anger over the Karachi administration in cases pertaining to encroachments in the city.

According to the details, according to the details, Chief Justice Gulzar Ahmed resumed hearing in the Karachi registry on the petitions against the encroachments in the city. Commissioner Karachi and other senior officials appeared in court.

Commissioner Karachi

The Chief Justice remarked that, ‘Dismiss Commissioner Karachi, he does not know anything about this city.’

CJP remarked that, Commissioner Karachi and Director General Sindh Building Control Authority (DG SBCA) are unaware that how many NAB references will be filed against them.’ Adding that, ‘DG SBCA and Commissioner Karachi are just rubber stamp.’

CJP questioned ‘if they are creating problem for us, then how much they are causing trouble to ordinary citizens?’

On the occasion, Justice Ijaz-ul-Ahsan remarked that Commissioner Karachi should have submitted his report instead of the Deputy Commissioners.

Hill Park encroachment case

While hearing the petition related Hill Park, The Chief Justice asked Commissioner Karachi to tell what happened about the Hill Park case. Commissioner Karachi replied that some residents have filed review petitions. The lawyer who was representing the residents argued that ransom should be paid as valid documents are available of the house bought 40 years ago. After hearing the arguments the court rejected the residents’ application to become parties in the Hill Park encroachment case.

The court directed commissioner Karachi to complete the renovation of Bagh Ibn Qasim and sought a progress report at the next hearing.

Nasla Tower Case

Supreme Court has ordered the demolition of the highrise residential building Nasla Tower on Karachi’s Sharae Quaideen.

According to the Sindh Building Control Authority, the building has not been constructed on any nullah, the commissioner remarked.

The advocate general said that one side of the building is illegal and that should be demolished.

“Don’t talk about the SBCA in front of us,” the judge said. They are responsible for all illegal constructions in Karachi. “There is not vacant land in PECHS. Where did this land come from?”

The SBCA DG said that this land was spotted after the re-allotment of the road.

To this, the top judge remarked: “So does this mean that you would sell this land? What have you been doing? You will even allot CM House if you could.” Justice Ijazul Ahsan asked who approved the lease on this land. The builder never comes to the court. He is missing, Justice Ahmed remarked. “He has even convinced the authorities to make a report in his favor.”

CJP remarked that, ‘billions of rupees are deposited in SBCA every month, Sub-Registrar’s Office of SBCA is the biggest money maker.’

KCR case

During the hearing of Karachi Circular Railway case, the Commissioner Karachi informed the court that the Track has been handed over to the Railway Authority.
