Negotiations over the European Union’s proposed AI Act have hit a snag over the regulation of generative AI, or “foundation models,” sources.

The draft AI rules, which were approved by the European Parliament in June, now need to be agreed upon through meetings between representatives of the European Parliament, the Council, and the European Commission.

However, experts from EU countries are unable to agree on how to regulate foundation models, such as the one built by Microsoft-backed OpenAI. Some experts and lawmakers have proposed a tiered approach, while others have said that all foundation models should be subject to the same rules.

France, Germany, and Italy have also expressed concerns about the proposed rules, arguing that they could stifle innovation. The countries have instead proposed a self-regulation approach for generative AI.

The disagreement over foundation models has raised the risk that the AI Act could be shelved. If no agreement is reached by December, the act will likely be delayed until after the European parliamentary elections next year.
