The US Supreme Court recently found that President Joe Biden’s administration; had the right to stop a Trump-era policy that required certain asylum seekers; to wait in Mexico while they awaited immigration hearings in the US.

The Migrant Protection Protocols; also known as “Remain in Mexico,” a policy that was initially implemented under previous President Donald Trump; were the subject of a decision; by the Supreme Court’s justices on Thursday. The result was reached by a vote of five to four. The court’s three liberal justices, Stephen Breyer, Sonia Sotomayor, and Elena Kagan; as well as Chief Justice John Roberts and fellow conservative Justice Brett Kavanaugh; drafted the ruling.

On his first day in office in January 2021; Biden halted MPP. But after being sued by the Republican-led states of Texas and Missouri; lower courts decided to reinstate it. Even so, compared to the Trump administration; much fewer people have been sent back to Mexico.

The main issue in the legal dispute was whether immigration authorities; who had significantly less room for detention than necessary; had to send people to Mexico or if they were allowed by federal law; to let them enter the country while they awaited their hearings.
