Mayor of San Francisco has proposed camera access laws

On Wednesday, the mayor of San Francisco, California, submitted legislation to improve and clarify local regulations restricting the use of cameras in circumstances with major public safety implications and in communities experiencing urgent public safety difficulties.

According to a news release from Mayor London Breed’s office, this ordinance is part of a citywide, multi-departmental adoption of technology use policies to strategically use technological advances to strengthen and expand the delivery of city services to residents, businesses, visitors, and neighbourhoods.

The airport, Department of Elections, Fire Department, Juvenile Probation Department, Municipal Transportation Agency, Public Library, Recreation and Parks Department, and War Memorial are among the departments having upcoming technology usage regulations.

The bill will clarify and expressly permit law enforcement to utilise non-city-owned cameras temporarily to react to difficulties posed by organised crime, killings, gun violence, and police misconduct, among other crimes, while enhancing important controls and monitoring to avoid misuse.

According to Breed, “This balanced proposal will help police deal with urgent public safety events, as well as support criminal investigations around issues like violent crime, retail theft, and drug dealing in our residential neighborhoods.”

Temporary live monitoring will end and the link will be broken within 24 hours after the non-city organisation has supplied access to the San Francisco Police Department, according to the ordinance’s terms.

According to the news release, when making requests for non-government camera footage or temporary live monitoring of non-city-owned cameras, the Department has considered and carved out safeguards relating to potential impacts on the right to privacy, loss of liberty, warrantless searches, and equal protections.
