Nick Kyrgios, a tennis player from Australia, has admitted to abusing an ex-girlfriend but escaped punishment.

The 27-year-old entered a guilty plea in a Canberra court after his attorneys were unsuccessful in getting the charge dropped due to his mental condition.

During a dispute in Canberra in 2021, Mr. Kyrgios pushed Chiara Passari onto the sidewalk, the court heard.

When sparing him a criminal record, the magistrate referred to the incident as “a single act of folly or frustration.”

According to facts that have been agreed upon and submitted to the court, Mr. Kyrgios pushed Ms. Passari on January 10, 2021, after she prevented his car from driving away while they were arguing.

The following month, Ms Passari reported the event to police but did not file a formal complaint. Ms Passari filed a formal complaint in December 2021 after the pair reconciled and renewed their relationship.

Mr. Kyrgios, according to his lawyer Michael Kukulies-Smith, was attempting to de-escalate the conflict by calling an Uber and had repeatedly attempted to “lawfully” relocate Ms Passari away from the car prior to the incident.

“It was in that environment, and the resulting frustration, that my client reacted, and the offence occurred,” he explained.

“There is a link between mental health and offending, even if he no longer suffers from it to the same amount now.”

According to Mr. Kukulies-Smith, Mr. Kyrgios expressed his regret to Ms. Passari the following day and acknowledged his guilt.

When sentencing Mr Kygrios, Magistrate Beth Campbell said he had been “a young guy seeking to remove himself from a heighted emotional circumstance”.

“You behaved in the heat of the moment,” she pointed out.

“I’m treating you the same as I would any other young guy in this court. You are a young man with an exceptional ability to strike a tennis ball.”

She informed Mr Kyrgios that family references proved he had a lot of “love and support” surrounding him.
