LHC orders immediate release of Sanam Javed
LAHORE: Lahore High Court (LHC) has ordered immediate release of Pakistan Tehreek-e-Insaf (PTI) leader Sanam Javed from jail.
The written decision of Sanam Javed’s petition against arrest in Gujranwala case has been issued.
A 2-member bench headed by Justice Asjad Javed Gharal issued a 14-page written decision.
The judgment said that repeatedly naming the petitioner in a case of the same nature shows malice, the purpose of repeatedly arresting the petitioner after his release is to defeat the judicial system.
It has been said in the judgment that the Deputy Commissioner Lahore and Gujranullah issued orders for the detention of the petitioner despite being in jail, demanding strict action against the Deputy Commissioners, but the court is showing arrogance and is not taking action.
The court said in the decision that the courts giving physical remand should also keep the fundamental rights given in the constitution in front while giving remand.
The judgment said that there is no evidence with the investigating officer to name the petitioner in the case. The case against the petitioner was registered at Guajarnwala on the basis of malice, the petitioner is discharged from the case forthwith.
According to the written verdict, the Deputy Prosecutor General stated that no further case has been filed against Sanam Javed.
The court directed to send a copy of the verdict to the judicial officers, IG and all deputy commissioners
