When both the musician and the reality TV actress wanted to call their cosmetic lines ‘Kylie,’ the Can’t Get You Out Of My Head singer took the reality TV celebrity to court in 2017.
Kylie won because she was older and more established, but the 54-year-old has subsequently stated that it was “just business.”
In an appearance on Andy Cohen’s Watch What Happens Live in the United States, the Princess of Pop discusses the trademark issue.
“It was just business, obviously,” she revealed.
Explaining why it was necessary to take the case to court, she explained: “Look, when I was named Kylie, I think I met one person older me called Kylie. So it’s kind of unusual.”
She continued: “I’ve spent a lifetime protecting my brand and building my brand, so it was just something that had to be done.”
High-fiving Kylie, TV host Andy yelled: “Yes it did!” as the audience applauded.
“But let me also say we came to an agreement,” Kylie added.
“Yes you did,” said Andy before asking Kylie: “Did you like have to call Kris Jenner and be like ‘Let me tell you something?’”
Kylie replied: “No, but I’d love to meet them.”
Kylie Jenner filed a trademark application for her name in 2014, a year before she formally established her $1 billion beauty enterprise.
However, court documents from early 2016 revealed that music diva Kylie Minogue had filed a formal opposition to the application.
She described Jenner as “a secondary reality television personality who appeared on the television series Keeping Up With the Kardashians as a supporting character.”
While Kylie Minogue was described as an “internationally-renowned performing artist, humanitarian and breast cancer activist known worldwide simply as “Kylie”.’
Minogue already had a number of trademarks, including the term ‘Kylie’ for educational and entertainment services.
She had been selling perfume and clothing under the name ‘Kylie’ since August 21, 1996, a year before Jenner was born, and she had owned the domain name kylie.com since August 21, 1996.
Allowing Jenner to use the sole name ‘Kylie’ could cause confusion and “harm” to Minogue’s brand, according to her legal team.
The reality star’s patent application was rejected by the United States Patent and Trademark Office in 2017.
