Montana has refused to implement a transgender birth certificate ruling
HELENA (AP) — The ACLU of Montana claimed it has been a month since a Montana judge temporarily blocked enforcement of a state law requiring transgender people to undergo surgery before changing their gender on their birth certificate, and the state has yet to comply with the court decision.
The state health department’s spokesperson, Jon Ebelt, said the agency is still reviewing the April 21 verdict and its ramifications with the Department of Justice.
When asked if this meant the state was considering appealing the order, he did not comment.
“We have remained patient in affording the state time to comply with the preliminary injunction issued by the court,” “In a recent statement, the Montana ACLU noted. “However, it has been nearly a month, and the State’s deliberate disregard for the court order is reprehensible.”
