In a recent development, lawyers for Donald Trump have launched fresh legal challenges against the federal election subversion case, arguing that the indictment violates the former president’s free speech rights and is a product of vindictive prosecution.

These motions, filed on Monday, come in addition to an existing argument put forth by Trump’s defense team, asserting that he is immune from federal prosecution for actions taken during his official tenure as president.

Special counsel Jack Smith’s team had previously called for the rejection of this immunity claim, and they are expected to do the same for the latest motions.

While it’s customary for defendants to seek dismissal of charges, such requests are rarely granted.

However, in Trump’s case, these challenges to the indictment could, at the very least, lead to a delay in the impending trial set for March in Washington.

These legal motions strike at the core of Trump’s repeated claims. Firstly, they argue that he is being politically targeted by the Biden administration’s Justice Department.

Secondly, they contend that Trump was well within his First Amendment rights to question the election’s outcome and allege widespread fraud, despite a lack of support for these claims in courts nationwide, including his own attorney general’s findings.
