In a landmark resolution to the legal battle between tech giant Apple Inc. and users of its Family Sharing program, a $25 million settlement has been announced, offering compensation to millions of eligible customers.

The lawsuit, Walter Peters v Apple Inc, alleged deceptive advertising in promoting Family Sharing alongside subscription-based apps on the App Store that did not support the service.

The settlement specifically addresses concerns that Apple misled customers into purchasing subscriptions through third-party apps, creating a wave of discontent among Family Sharing plan users. Although Apple denies any wrongdoing or misleading conduct, it has agreed to the $25 million settlement to bring closure to the dispute.

US customers who had a Family Sharing plan and purchased a third-party app subscription between June 21, 2015, and January 30, 2019, are eligible to file a claim. The filing deadline is set for March 1, 2024, and eligible users can expect compensation “up to $30.” To claim, users must visit the dedicated claims website, where they can file online with an identification number and PIN or download, complete, and mail in a payment election form if they lack the necessary credentials.

Compensation preferences, either electronic ACH transfer or a check, must be indicated before the filing deadline. Those deemed eligible will receive an email notification about the settlement, and if no notice is received, users can still file a claim using the form on the settlement website.

For users wishing to opt-out, signaling an intent to pursue a separate lawsuit against Apple, an opt-out request must be submitted by mail to the Peters v Apple Class Action Settlement Administrator by March 1, 2024. Alternatively, an opt-out request form can be completed online, printed, and mailed to the specified address.

The resolution marks a significant development in the ongoing discussions surrounding consumer rights and digital services. Apple users affected by the alleged deceptive advertising will now have the opportunity to claim their share of the $25 million settlement and potentially pave the way for increased scrutiny of subscription services in the tech industry.
