The Inspector General’s office of the Department of Justice said Wednesday that one of its own workers leaked a draft report to the media that contained non-public material. According to the IG’s office, after learning about the stolen paper, they reported the case to the Integrity Committee of the Council of Inspectors General on Integrity and Efficiency for further inquiry.

While the committee declined to investigate since no complaints were made against anybody within their authority, they later picked another Inspector General’s office to conduct an independent investigation.

“The independent investigation conducted by the other Office of Inspector General concluded that a then-DOJ OIG employee was responsible for sensitive, non-public information from and about the then-ongoing DOJ OIG review, including information from the draft DOJ OIG report, being provided to various media outlets on several occasions prior to the completion and official public release of the DOJ OIG’s final report, and that the employee did so without authorization from DOJ OIG.”

Following a Freedom of Information Act request, Fox News learned that the investigation the employee had discussed with the media was related to the Trump administration’s “Zero Tolerance” border crossing policy, which resulted in mass detentions and family separations until then-President Donald Trump called for an end to the practice.

That investigation included a review of the now-former DOJ Inspector General employee’s phone records, which “reflected numerous and lengthy phone conversations between the then DOJ OIG employee and reporters at media outlets during the time period in which articles about the then-ongoing DOJ OIG review were published.”

According to the summary, the investigation also revealed that the worker “abruptly left” just before they and other workers “were requested to give sworn responses to a questionnaire about the illegal disclosures to the media.”

The now-former employee was the only one who did not answer questions, and they refused to be interviewed by investigators after their resignation, according to the DOJ Inspector General’s office, which also noted that they do not have a subpoena power over former employees, even those who resign during investigations.

The inquiry concluded that the now-former employee violated office rules as well as federal ethics standards. Because the ex-employee is a lawyer, the investigation’s office also forwarded its findings to the DOJ’s Office of Professional Responsibility “for appropriate action.”

The individual in issue notified the IG’s office through his counsel that he “denies in the strongest possible terms communicating sensitive non-public material… with members of the media.”
