A recent alteration to UAE law has simplified the process for medical professionals to conduct abortions in situations where the mother’s life is in danger. This change has been commended by legal experts and ensures that pregnant women have full control over their healthcare choices.

Hadiel Hussein, a senior associate at BSA Ahmad Bin Hezeem & Associates LLP, explained that the amendment modified previous provisions to specify that only the pregnant woman’s consent, rather than her husband’s, is necessary to proceed with an abortion procedure, subject to certain conditions.

Under the updated regulation, if a woman cannot provide consent, her husband or male relatives as defined by the Personal Status Law may consent instead. Emergency cases that require immediate surgical intervention do not require consent.

Medical practitioners can perform abortions in two situations: when the continuation of the pregnancy threatens the mother’s life or when fetal deformity is confirmed. However, strict conditions outlined by the law must be met in both cases.
