According to the San Jose Mercury News, George Robles, 42, was sentenced on Friday after entering a no contest plea to counts of animal maltreatment, commercial burglary, and vandalism.
In the days leading up to and following the attack in January of last year, he stole items worth thousands of dollars and was apparently connected to earlier break-ins at the daycare in East San Jose.
Robles was given a two-year probationary term as well as ordered to undergo obligatory drug and alcohol rehab. Additionally, he was prohibited from owning any animals for a decade.
According to the defendant’s attorney, his treatment of the tortoise was the product of severe intoxication rather than intentional cruelty to animals.
After being attacked, the tortoise required surgery, but the veterinarian who carried out the procedure said that it was “doing fantastic.”
