Germany sues Italy for reparations for Nazi atrocities

Germany filed a complaint against Italy before the International Court of Justice on Friday, claiming that Rome is still claiming World War II reparations, therefore “failing to respect its jurisdictional immunity,” according to the court.

In 2012, the United Nations’ top court found that Italy had failed to meet its commitments by permitting victims of Nazi atrocities committed between 1943 and 1945 to file reparation claims against Germany.

Despite the judgement, Italian courts “have considered a large number of new claims… in breach of Germany’s sovereign immunity,” according to Berlin’s application.

Germany, in particular, cited an Italian Constitutional Court decision from 2014 that allowed “individual claims by victims of war crimes and crimes against humanity to be pursued against sovereign governments.”

Germany said that the judgement was “adopted in willful contravention of international law and Italy’s responsibility to comply with a judgement of the chief judicial instrument of the United Nations.”

According to the International Court of Justice, Germany asserts that at least 25 new lawsuits have been filed against Berlin in Italian courts, and that at least 15 procedures have “entertained and resolved upon claims against Germany in respect to the conduct of the German Reich during World War II.”
