Jurors will be unable to examine GPS emails given up in the Durham investigation.

As the trial of Clinton campaign lawyer Michael Sussmann begins Monday, a federal court has determined that the 22 emails ordered to be given over to Special Counsel John Durham are prohibited from jury view. Sussman claimed to have obtained information on a computer server in Trump Tower in Manhattan that was purportedly interacting with a Russian bank. The charge was shown to be untrue. Sussman allegedly told FBI General Counsel James Baker that he intended to bring the material to light as a concerned citizen, not on behalf of the Clinton campaign or “any client.”

Cooper ordered Fusion GPS to turn over 22 emails between Sussmann and the opposition company late Thursday.

Durham may utilize the emails in any future lawsuit, even if they cannot be used in the current case.

The trial is likely to take two weeks, and the jury will decide whether Sussmann lied to the FBI and whether his knowledge influenced how the investigation was handled.
