During petitions against Punjab Chief Minister and leader of Pakistan Muslim League Nawaz (PML-N) leader Hamza Shahbaz, the court gave remarks and said, it was the duty of the secretary assembly to prevent people from entering the assembly.
Throughout the hearing on the appeals of the Pakistan Tehreek-Insaf (PTI), Pakistan Muslim League-Q leader Pervez Elahi and others against the election of Hamza Shahbaz as the chief minister. Giving three judicial precedents, PTI lawyer Barrister Ali Zafar said in his arguments that Article 63A would apply.
The PTI lawyer said that even Supreme Court’s brief order is sufficient for implementation. As in the constitution, it is mentioned that whoever has a numerical majority will become the chief minister, he added. “The Speaker’s decisions have constitutional protection. Courts cannot interfere in parliamentary affairs,” he maintained.
Advocate Ali Zafar claimed that the case of the election of the CM came to this court. The election was held on court’s order. During the voting of the chief minister of Punjab, the speaker exercised his constitutional powers.
The PTI counsel argued that the courts could intervene if there was malice in any action taken by the Speaker. According to Article 130 of the Constitution, the chief minister must have a numerical majority. Even before the interpretation of 63A, 63A existed, it was applicable.

Advocate Ali Zafar said that no one now has a numerical majority. This issue will again go to the election of the CM. In the second round of voting, 186 votes will have to be occupied.
Chief Justice Lahore High Court asked regarding the total number of members in the assembly. Ali Zafar responded that Punjab Assembly has 371 members.
After the arguments of PTI lawyer Barrister Ali Zafar, Aamir Ran advocate of Pakistan Muslim League-Q argued that IG Punjab had introduced police at court. And, the IG said the court had ordered so.
The PML-Q lawyer said that the court had not issued such an order and several members could not cast their votes due to police interference. The court said that everyone saw what happened and the Secretary Assembly did not show his responsibility on this occasion.
The PML-Q lawyer argued that the deputy speaker had met the opposition. While, Chief Justice Muhammad Amir Bhatti said that instead of answering his question, he is taking the matter to the other side. Everyone saw what happened to the Deputy Speaker on TV. It was the job of the Secretary Assembly to prevent people from entering the Assembly.
The court remarked that it was shameful to return to the Assembly. There are disputes in Assemblies over the world but what happened to the Deputy Speaker that day was unfortunate.
