ISLAMABAD: The Supreme Court of Pakistan on Wednesday dismissed a petition seeking postponement of the second phase of Local Government (LG) elections in Sindh.
A three-member bench headed by Chief Justice of Pakistan (CJP) Umar Atta Bandial heard the petition by the Muttahida Quami Movement-Pakistan (MQM-P) regarding the delimitation of constituencies for the local bodies elections.
During the hearing, the chief justice said the delimitation of constituencies is carried out by Election Commission of Pakistan (ECP) and the local administration based on population. The court instructed the petitioner to approach the appropriate forum for the delimitation of constituencies.
The top court maintained that those points not raised in the high court cannot be discussed during the appeal. In the present case, the implementation of the court verdict cannot be reviewed it added.
Additional Attorney General told the court that the government had framed the guidelines in the light of the court’s decisions. Chief Justice Umar Atta Bandial said that the court cannot decide on those matters which have been raised before the Sindh High Court.
The top judge said the issue should be resolved after contacting the ECP and delimitation committee. He asked the MQM’s lawyer if the case should be sent back to the high court.
It also dismissed a petition filed by the PTI regarding the implementation of the court’s February 1 order and instructed to file a separate review petition.
The apex court dismissed the plea seeking postponement of the second phase of Sindh LG elections. It maintained that the second phase of polls will be held on as scheduled on August 28.
