ISLAMABAD: The Accountability Court issued a detailed decision to send the Toshakhana reference against former President Asif Ali Zardari, Yousuf Raza Gilani and Nawaz Sharif back to NAB.
The accountability court said in a detailed decision that the lawyers argued that under the NAB ordinance, the accountability court does not have jurisdiction over cases worth less than 500 million.
It was stated that the prosecution said that the Toshakhana reference is a case of corruption of Rs 118.52 million, Section 5O was added under the NAB Ordinance Amendment Act.
The court said that under Section 5O, only cases involving Rs 500 million or more come under the jurisdiction of the accountability court adding that the Accountability Court does not have jurisdiction in this case under Section 5O.
In a detailed judgment, the Court of Accounts ordered that NAB refer the reference to the relevant forum.
Pertinently, Asif Ali Zardari, Yusuf Raza Gilani and Nawaz Sharif were named accused in the Toshakhana reference. The Khawaja brothers of Omni Group were also named accused in the case.
The detailed decision has been issued by Judge Muhammad Basheer.
