The Islamabad High Court (IHC) on Saturday ordered stopping any construction on the plot allotted to a private educational institution in F-11 area.

Justice Mian Gul Hasan Aurangzeb, presiding over the case, issued a comprehensive 9-page order, addressing various pertinent issues.

One pressing matter raised in the court’s deliberations was the absence of the appointment of the Director-General (DG) of the Federal Directorate of Education, a concern that the Ministry of Education was asked to explain.

Another noteworthy aspect of the case revolved around the concept of free education in public-private partnership schools.

It was observed that offering free education to only 20% of students in such schools might be viewed as a constitutional violation, a point highlighted by the court.

Furthermore, the court emphasized that the Secretary acting as the DG of the Federal Directorate of Education could not make policy decisions in an additional capacity.

As the case unfolded, the court called upon the Federal Directorate of Education to provide a report addressing the concerns raised by the Ministry of Education regarding the plot allotment.

The court’s order also explicitly directed that no construction of any kind should take place on the contested plot until the next hearing, underscoring the gravity of the issues at hand.

The case is slated for further proceedings on November 21, and this decision comes in response to a request made by the teachers’ association.
