According to express.co.uk, Prince Harry and Meghan Markle may choose to plead the Fifth Amendment, following in the footsteps of former US President Donald Trump, if they are required to testify in Samantha Markle’s lawsuit against the Duchess of Sussex.
The magazine said that the fifth amendment grants an individual the liberty to refuse to answer any queries and proclaim “no comment”.
Samantha, Meghan’s estranged half sister, is suing the Duchess for a comment she made in an interview with Oprah Winfrey.
According to a report, a US court denied a stay of discovery in the defamation action, which means Meghan and Harry might be obliged to testify.
Lawyer Nathaniel Mack said that depositions (testimony) “can be seen as a form of torture”, especially for “high-profile individuals”, like the royal couple.
He said, “High-profile cases involving Governor Cuomo and President Trump involved nine and 11-hour depositions.”
According to Mack, the Sussexes’ “testimony will more than likely be limited in scope and reveal few new details” and will be “more of a procession than anything else.”
He stated that the Markle litigation is presently in the discovery stage, in which both parties can request evidence and information in preparation for the trial.
According to the lawyer, the judge’s decision indicates that Samatha’s attorneys would interrogate Meghan and Harry before July if the case progresses.
