A federal judge has once again imposed a limited gag order on former President Donald Trump in his 2020 presidential election subversion case, barring him from criticizing court staff, prosecutors, and potential witnesses until his trial.

The order was temporarily lifted by Judge Tanya Chutkan earlier this month to allow Trump’s legal team to appeal but has now been reinstated. Shortly after this development, Trump referred to the judge as a “Trump hating” individual.

Trump, who is the leading Republican candidate for the 2024 presidential race, faces charges related to his alleged efforts to overturn the 2020 election results in favor of Democrat Joe Biden.

The charges against him include conspiracy to defraud the US, conspiracy to obstruct an official proceeding, obstruction of an official proceeding, and conspiracy against the rights of citizens. He has pleaded not guilty, and the trial is set for March.

Special counsel Jack Smith, heading the investigation, initially sought the gag order, arguing that Trump’s outspoken comments could prejudice trial participants, including jurors and court staff. In the past, Trump has used derogatory terms to describe Smith.

The reasons for Judge Chutkan’s decision to re-impose the gag order have not been disclosed at this time.

Trump’s legal team contended that the order infringes on his right to free speech. They also requested the judge’s recusal from the case, citing perceived bias based on her previous comments.

In September, Judge Chutkan denied this request, stating that Trump’s lawyers had not presented evidence to support their claims.

In addition to this case, Trump is also subject to a gag order in a separate ongoing civil fraud trial in New York, where he has faced fines for violating the order.
