LAHORE: The Lahore High Court (LHC) heard the case of denotification of CM Punjab announced by Governor Baligh ur Rehman and sought assurance that assemblies will not be dissolved, only then the court will review the petition.

A hearing has been underway in the LHC on the petition of PML-Q against the denotification of CM Punjab Pervaiz Elahi. A new bench has been hearing the case as Justice Farooq Haider refused to be part of the bench.

The five-member bench of the court adjourned the hearing, giving Barrister Ali Zafar ten minutes to consult Pervaiz Elahi and inform the court.

The court remarked that the dissolution of the assemblies will bring a constitutional crisis and sought an affidavit in this regard for assurance.

At the outset of the hearing, Pervaiz Elahi’s lawyer Ali Zafar maintained before the court that if the Governor doesn’t feel satisfied with the CM then he can instruct him to take the vote of confidence but cannot remove him from the slot by a notification.

“Governor has no jurisdiction of appointing a CM similarly he cannot denotify.”

He also said that when the session was not called by the speaker then how the CM could take the vote of confidence adding that the time to take the vote of confidence is three to seven days which the governor ignored while issuing the notification.

Advocate Ali Zafar argued that the Punjab Governor misinterpreted Article 130 Sub-Section 7 of the Constitution. The Punjab governor de-notified the chief minister by misusing the powers.

Parvaiz Elahi’s lawyer argued that if there is no chief minister and Cabinet, how will the affairs of the state be run?
