Karachi: A constitutional petition has been filed against the de-notification of Punjab Chief Minister Chaudhry Pervaiz Elahi and the dissolution of the provincial cabinet.

The petition was filed in the Lahore High Court by Barrister Ali Zafar, the lawyer of Chief Minister Chaudhry Pervaiz Elahi, which consists of five pages.

Governor Punjab, the Government of Punjab, and Chief Secretary Punjab have been made parties in the constitutional petition.

In the petition, it was argued that the Governor of Punjab misinterpreted Article 130 sub-section 7 of the Constitution, the Governor of Punjab misused the powers and de-notified the Chief Minister.

It was stated in the position that the Governor of Punjab had no authority to take any action after the speaker’s ruling, the governor gave an unconstitutional order to call a second session for the vote of confidence in the ongoing session, under the constitution, the governor is not the chief minister’s authority.

It was argued in the petition that the Chief Secretary of Punjab issued an illegal notification to suspend him(CM) from work and dissolve the cabinet without the approval of the Chief Minister. The Chief Secretary of Punjab directly implemented any order of the Governor without the approval of the Chief Minister.

In the petition, it was requested that the ongoing notifications of the Governor and Chief Secretary Punjab should be declared null and void and the court should declare the actions of the Governor Punjab annulled.

It should be noted that the constitutional petition was prepared by Barrister Ali Zafar, Aamir Saeed Ran, and a team of lawyers on the instructions of Chief Minister Chaudhry Pervaiz Elahi while Advocate General Punjab Ahmed Owais was also consulted in the preparation of the constitutional petition.

Earlier, Governor Punjab Baligh ur Rehman de-notified Punjab Chief Minister Chaudhry Pervaiz Elahi.

According to the notification, Pervaiz Elahi and the cabinet are constitutionally inactive for not taking the vote of confidence and therefore Pervaiz Elahi is being de-notified.
